1Acceptance of Terms
These Terms of Service (“Terms” or “Agreement”) constitute a legally binding agreement between you (“User”, “you”, or “your”) and Onsurity Technologies Private Limited (“Onsurity”, “we”, “us”, or “our”), a company incorporated under the Companies Act, 2013 and registered as an insurance broker with the Insurance Regulatory and Development Authority of India (“IRDAI”).
By accessing or using our website at www.onsurity.com (the “Website”), our mobile application, or any of our services (collectively, the “Platform”), you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
If you do not agree to these Terms, you must immediately cease using the Platform and services. If you are accessing the Platform on behalf of a business entity, you represent and warrant that you have the authority to bind that entity to these Terms.
These Terms are effective as of 01-Jan-2026 and supersede all prior versions. Your continued use of the Platform after any modifications to these Terms constitutes your acceptance of the revised Terms.
2Definitions
In these Terms, the following words and expressions shall have the meanings ascribed to them below unless the context otherwise requires:
- "Platform"
- The Onsurity website (www.onsurity.com), mobile applications, APIs, and any related digital interfaces owned or operated by Onsurity Technologies Private Limited.
- "Services"
- All services offered by Onsurity, including but not limited to employee group health insurance, SureBiz business insurance, employee wellness benefits, claims assistance, and any ancillary or supporting services provided through the Platform.
- "User" / "You"
- Any individual or entity that accesses or uses the Platform, including business owners, HR managers, authorised representatives of companies, and individual employees accessing their benefits.
- "Business User"
- A company, firm, LLP, or any other business entity registered in India that subscribes to Onsurity's group benefit plans on behalf of its employees.
- "Policy"
- The insurance policy or certificate of insurance issued by an IRDAI-licensed insurer through Onsurity acting as an insurance broker.
- "Premium"
- The periodic amount payable by the Business User for the insurance cover and/or benefit plans selected on the Platform, as quoted and agreed at the time of enrolment or renewal.
- "Insurer"
- An insurance company licensed by the IRDAI that underwrites the group health insurance or other insurance products distributed through the Platform.
- "Member" / "Employee"
- An individual employee (and optionally their dependants) enrolled under a Business User's group benefit plan on the Platform.
- "Account"
- The registered account created by a User on the Platform to access and manage their subscribed Services.
- "Content"
- All text, graphics, user interfaces, visual interfaces, photographs, logos, sounds, music, artwork, and computer code on the Platform, including but not limited to the design, structure, selection, coordination, expression, and arrangement of such content.
- "Applicable Law"
- All laws, statutes, regulations, guidelines, and rules applicable in India, including but not limited to the Information Technology Act, 2000, the Insurance Act, 1938, IRDAI regulations, the Consumer Protection Act, 2019, and the Indian Contract Act, 1872.
3Description of Services
Onsurity is India’s leading employee benefits platform designed for startups, SMEs, and growing businesses. We offer:
3.1 Employee Healthcare (Group Health Insurance)
Group health insurance plans that provide cashless hospitalisation at 10,000+ network hospitals across India, starting at ₹145 per employee per month. Plans include inpatient hospitalisation, pre- and post-hospitalisation expenses, and optional add-ons such as OPD, dental, vision, and maternity benefits, subject to the terms of the underlying Policy.
3.2 SureBiz — Business Insurance
Commercial insurance solutions for SMEs, including office package policies, professional indemnity, directors and officers liability, and cyber insurance. Products and coverage terms vary by insurer and plan selected.
3.3 Employee Wellness Benefits
Supplementary wellness perks including teleconsultation credits, health check-up vouchers, pharmacy discounts, fitness benefits, and mental wellness support. Availability and terms of wellness benefits may vary by plan and may be subject to third-party service providers' own terms and conditions.
3.4 Platform & Advisory Services
Self-service tools for policy management, employee enrolment and de-enrolment, premium payment, claims filing and tracking, policy document access, and benefit analytics dashboards. We also provide telephonic and digital advisory services to help Business Users select appropriate insurance products.
Onsurity acts solely as an IRDAI-registered direct insurance broker (Registration No. pending regulatory disclosure) and does not underwrite any insurance product. All insurance products are underwritten by IRDAI-licensed insurers. Insurance cover is subject to the policy wordings, exclusions, and terms issued by the respective insurer.
4User Eligibility
To register for and use the Platform, you must satisfy all of the following eligibility criteria:
- You are a business entity legally incorporated or registered in India (including private limited companies, LLPs, partnerships, proprietorships, and trusts), or an individual representing such an entity.
- If you are an individual representative acting on behalf of a Business User, you are at least 18 years of age and are legally competent to enter into contracts under the Indian Contract Act, 1872.
- You possess the necessary authorisation from your organisation to subscribe to Services, accept these Terms, and bind your organisation to this Agreement.
- Your use of the Platform does not violate any applicable Indian law or regulation.
- You are not subject to any court order or regulatory action that prohibits you from engaging in transactions of this nature.
- You have not previously been suspended or removed from the Platform by Onsurity.
Onsurity reserves the right to verify eligibility at any time and to refuse, suspend, or terminate access to any User who does not meet the above criteria or who provides false or misleading information during registration.
5Account Registration & Security
5.1 Registration
To access most features of the Platform, you must create an Account by providing accurate, current, and complete information including your business name, GSTIN (if applicable), registered address, authorised representative details, and a valid business email address. You agree to update this information promptly if it changes.
5.2 Account Credentials
You are responsible for maintaining the confidentiality of your Account login credentials, including your username, password, and any OTP or two-factor authentication codes. You agree not to share your credentials with unauthorised persons and to notify Onsurity immediately at security@onsurity.com if you suspect any unauthorised access to your Account.
5.3 Account Responsibility
You are solely responsible for all activities that occur under your Account, whether or not authorised by you. Onsurity will not be liable for any loss or damage arising from your failure to maintain adequate security of your Account credentials.
5.4 Multiple Users
A Business User may designate multiple administrators or HR managers to access a single Account. You are responsible for ensuring that all such persons comply with these Terms and any applicable platform usage policies communicated to you by Onsurity.
5.5 KYC / Verification
Onsurity may require Know Your Customer (KYC) verification of the Business User and/or its authorised representative in compliance with Applicable Law and IRDAI guidelines. Failure to complete required verification may result in suspension of Services until verification is completed to Onsurity’s satisfaction.
6Insurance Services Disclaimer
Important: Onsurity Technologies Private Limited is registered as a Direct Insurance Broker with the Insurance Regulatory and Development Authority of India (IRDAI). We are NOT an insurance company and do NOT underwrite any insurance product or assume any insurance risk.
6.1 Role of Onsurity
Onsurity acts as an intermediary between Business Users and IRDAI-licensed insurance companies. Our role includes facilitating the purchase of insurance policies, assisting with enrolment, providing advisory services, and supporting claims processes. The actual insurance contract is between the Business User (policyholder) and the respective Insurer.
6.2 Policy Terms and Conditions
All insurance products are subject to the policy wordings, terms, conditions, inclusions, and exclusions specified in the respective Policy documents issued by the Insurer. In the event of any conflict between the information on the Platform and the Policy document, the Policy document shall prevail. You are strongly advised to read the Policy document carefully before purchasing any insurance product.
6.3 Coverage Limitations
The Platform provides general information about insurance products. Coverage under any Policy is governed solely by the terms of the relevant insurance contract. Onsurity makes no warranty or guarantee regarding the scope, extent, or approval of any claim under any insurance Policy.
6.4 Regulatory Compliance
All insurance products distributed through the Platform are approved by IRDAI. Onsurity complies with the IRDAI (Insurance Brokers) Regulations, 2018, and all applicable amendments thereto. Grievances related to insurance products may also be escalated to the IRDAI Grievance Call Centre (IGCC) or the Insurance Ombudsman.
6.5 No Financial Advice
Information provided on the Platform does not constitute financial, legal, or tax advice. You should consult qualified professionals for advice specific to your circumstances before making insurance or financial decisions.
7Premium Payments & Refunds
7.1 Premium Calculation
Premiums are calculated based on factors including the number of employees enrolled, their age bands, the sum insured, coverage type, and the selected Insurer’s underwriting criteria. Premium quotes displayed on the Platform are indicative and subject to final underwriting approval by the Insurer.
7.2 Payment Terms
Premiums are typically payable annually or as otherwise agreed at the time of subscription. Onsurity accepts payment via NEFT, RTGS, UPI, net banking, credit/debit cards, and other payment methods available on the Platform. All amounts are in Indian Rupees (₹).
7.3 GST and Other Levies
Goods and Services Tax (GST) and any other applicable levies are charged in addition to the base premium, at the rates prescribed by the Government of India from time to time. Onsurity will provide a GST invoice for all payments collected.
7.4 Payment Security
All premium payments are processed through PCI-DSS compliant payment gateways. Onsurity does not store your card details on its servers. By making a payment, you authorise Onsurity to collect and remit the applicable premium and taxes to the Insurer on your behalf.
7.5 Refund Policy
Refund of premiums, if applicable, is governed by the terms of the respective Policy and IRDAI regulations. In general:
- Cancellation during the free-look period (typically 15 days from policy issuance for new policies): Premium refund less proportionate risk premium for the days of cover and applicable medical examination costs, as per IRDAI guidelines.
- Cancellation after the free-look period: Refund, if any, is on a short-period basis as per the Insurer's schedule of short-period rates and subject to no claims having been made under the Policy.
- Pro-rata refunds for mid-term deletions of employees (if permissible under the Policy) are subject to Insurer approval.
- Onsurity's facilitation fees, if charged separately, are non-refundable once Services have been rendered.
- Refunds may take 7–21 business days to process, depending on the payment method and the Insurer's internal processes.
7.6 Late Payments and Lapse
Failure to pay premiums by the due date may result in lapse or cancellation of the Policy. Reinstatement of a lapsed Policy is subject to the Insurer’s underwriting requirements, which may include fresh medical examination or waiting period imposition. Onsurity shall not be liable for any losses arising from a Policy lapsing due to non-payment of premiums.
8Cancellation & Termination
8.1 Cancellation by Business User
A Business User may cancel their subscription and/or the underlying Policy by providing written notice to Onsurity at support@onsurity.com. Cancellation of the Policy will be subject to the terms of the Policy and the Insurer’s cancellation procedure. Onsurity will facilitate the cancellation request but cannot guarantee the Insurer’s timeline for processing.
8.2 Termination by Onsurity
Onsurity may suspend or terminate your Account and access to the Platform with or without notice in the following circumstances:
- You breach any provision of these Terms and fail to remedy the breach within 7 days of written notice from Onsurity.
- You provide false, inaccurate, or misleading information during registration or in the course of using the Platform.
- You engage in fraudulent activity, including but not limited to submission of false claims.
- You use the Platform in a manner that violates Applicable Law or infringes third-party rights.
- Non-payment of dues owed to Onsurity or the Insurer.
- Onsurity is required to do so by Applicable Law or regulatory direction.
- Onsurity ceases to provide the relevant Service.
8.3 Effect of Termination
Upon termination, your right to access the Platform ceases immediately. Termination of your Account does not automatically cancel any underlying insurance Policy — Policy cancellation must follow the Insurer’s prescribed procedure. Provisions of these Terms that by their nature should survive termination (including Sections 10, 11, 12, and 13) shall continue to apply.
9User Obligations & Prohibited Uses
9.1 User Obligations
By using the Platform, you agree to:
- Provide accurate and truthful information at all times, including during employee enrolment and claims processes.
- Comply with all Applicable Laws, IRDAI regulations, and any guidelines or instructions issued by Onsurity from time to time.
- Use the Platform only for lawful purposes and in accordance with these Terms.
- Promptly notify Onsurity of any material change in your business (including number of employees, business activity, or registered address) that may affect your insurance coverage.
- Ensure that employee data provided to Onsurity is obtained with valid consent and in compliance with applicable data protection laws.
- Pay all dues (premiums, fees, and taxes) by the applicable due dates.
- Co-operate with Onsurity and the Insurer in the event of a claim, including providing all required documentation within stipulated timeframes.
9.2 Prohibited Uses
You must not, and must ensure that your employees and representatives do not, use the Platform to:
- Submit false, fraudulent, or exaggerated insurance claims.
- Enrol fictitious employees or individuals who are not genuine employees of your organisation in group insurance schemes.
- Reverse-engineer, decompile, disassemble, or attempt to extract the source code of any part of the Platform.
- Scrape, crawl, or use automated data-extraction tools on the Platform without Onsurity's prior written consent.
- Transmit viruses, malware, or any other malicious code to the Platform.
- Impersonate any person or entity, including Onsurity employees, or falsely misrepresent your affiliation.
- Use the Platform in a way that could damage, overload, or impair the functioning of Onsurity's systems or servers.
- Circumvent any access-control or security mechanism on the Platform.
- Violate any third party's intellectual property rights, privacy rights, or contractual rights.
- Engage in any activity that constitutes an offence under the Information Technology Act, 2000 or any other Applicable Law.
- Use the Platform for any purpose other than lawful business use.
Onsurity reserves the right to investigate and take appropriate legal action against any User who, in Onsurity’s sole discretion, violates this Section, including removing such User from the Platform and reporting to law enforcement authorities.
10Intellectual Property
10.1 Ownership
The Platform and all Content, including but not limited to the Onsurity name, logo, trademarks, trade dress, software, code, design, text, images, graphics, and data compilations, are the exclusive property of Onsurity Technologies Private Limited or its licensors and are protected under the Trade Marks Act, 1999, the Copyright Act, 1957, and other applicable intellectual property laws of India.
10.2 Limited Licence to Users
Subject to these Terms, Onsurity grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for your internal business purposes. This licence does not include the right to:
- Reproduce, modify, or create derivative works of any Platform Content.
- Sublicense, sell, rent, or otherwise transfer your rights to the Platform to any third party.
- Remove or alter any proprietary notices, labels, or marks on the Platform.
- Use the Onsurity name, logo, or trademarks in any marketing or promotional material without prior written consent.
10.3 User Content
Any data or content you submit to the Platform (including employee data, claims documents, and feedback) remains your property. By submitting such content, you grant Onsurity a limited, royalty-free licence to use, process, and store such content solely for the purpose of providing the Services to you. You warrant that any content you submit does not infringe third-party rights and that you have all necessary permissions to provide it.
10.4 Feedback
If you provide feedback, suggestions, or ideas regarding the Platform, Onsurity may use such feedback without restriction and without any obligation to compensate you.
11Limitation of Liability
Please read this section carefully. It limits Onsurity’s liability to you.
11.1 Disclaimer of Warranties
To the maximum extent permitted by Applicable Law, the Platform and Services are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. Onsurity does not warrant that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components.
11.2 Exclusion of Liability
To the maximum extent permitted by Indian law, Onsurity, its directors, officers, employees, agents, and partners shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Platform.
- Any loss of profit, revenue, data, goodwill, or business opportunity.
- Any claim or dispute arising from the terms of an insurance Policy issued by an Insurer — such disputes are between you and the Insurer.
- Any failure to provide Services resulting from circumstances beyond Onsurity's reasonable control, including acts of God, government actions, network failures, or third-party service disruptions.
- The accuracy or completeness of information provided by third parties through the Platform.
- Decisions made by an Insurer, including rejection or partial settlement of a claim.
11.3 Cap on Liability
To the extent permitted by Applicable Law, Onsurity’s aggregate liability to you for any claim arising under or in connection with these Terms shall not exceed the total amount of Onsurity’s service fees actually paid by you to Onsurity in the 12 months immediately preceding the event giving rise to the claim.
11.4 Statutory Rights
Nothing in these Terms is intended to exclude or limit liability that cannot be lawfully excluded under the Consumer Protection Act, 2019 or any other mandatory provision of Applicable Law. Your statutory rights as a consumer are not affected.
12Dispute Resolution
12.1 Good-Faith Negotiations
In the event of any dispute, controversy, or claim arising out of or relating to these Terms, the Platform, or the Services, you and Onsurity agree to first attempt to resolve the dispute amicably through good-faith negotiations. Either party may initiate this process by sending a written notice to the other party describing the nature of the dispute and the resolution sought. The parties shall have 30 (thirty) days from the date of such notice (“Notice Period”) to attempt to resolve the dispute.
12.2 Grievance Redressal
For Service-related grievances, you may first contact our Grievance Officer at grievance@onsurity.com. We aim to acknowledge all grievances within 48 business hours and resolve them within 14 business days. For insurance-related disputes, you may also escalate to the IRDAI Grievance Cell at igms@irda.gov.in or through the IRDAI Bima Bharosa system.
12.3 Arbitration
If a dispute is not resolved within the Notice Period, either party may refer the dispute to binding arbitration. The arbitration shall be conducted:
- Under the Arbitration and Conciliation Act, 1996, as amended from time to time.
- By a sole arbitrator mutually appointed by the parties, or if the parties fail to agree within 15 days of a written request, by an arbitrator appointed by the Bengaluru District Court.
- In the English language.
- At Bengaluru, Karnataka, India.
The arbitrator’s award shall be final and binding on the parties. Each party shall bear its own costs of arbitration unless the arbitrator directs otherwise.
12.4 Court Jurisdiction
Subject to the arbitration clause above, and for matters that are not arbitrable or for interim relief, both parties submit to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India.
13Governing Law
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of India.
The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply to these Terms.
14Changes to Terms
Onsurity reserves the right to modify, update, or replace these Terms at any time. When we make changes, we will:
- Post the revised Terms on this page with the updated "Last updated" date.
- Where required by Applicable Law or where changes are material, notify registered Business Users by email to the address on file, at least 15 days prior to the changes taking effect.
- For non-material or minor clarificatory changes, the updated Terms will be effective immediately upon posting.
Your continued use of the Platform after the effective date of any modification constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Platform and notify Onsurity to terminate your Account.
